美国高校学生雇员身份的认定Identification of the Student Employee Status in American Colleges and Universities

摘要(Abstract):
当前学生用工已经成为美国高校劳动力的重要替代力量,但是学生是否具有雇员身份则是一个极具争议的问题。美国的实践表明,学生的受教育者身份不是雇员身份认定的障碍,学生雇员身份的认定没有简单划一的形式要件,而是一个复杂的平衡性系统,认定学生雇员身份需要正确处理劳动与教育之间的关系。在一般雇员认定标准的基础上,美国法院确立的"主要受益人标准"和"整体情况标准"立足于学生的实际工作内容,既需要判断与学业和教育的关联性,也需要判断与常规劳动形态的关联性。总体而言,学生劳务与教育属性的关联性越小,与劳动属性的契合性越高,学生也就越会被认定为雇员,反之则只能被认定为受教育者。
